Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Outfi mobile application ("Outfi" or the "App"), operated by Enes Baydere, an individual operating Outfi as a sole proprietorship based in Texas, United States ("we," "us," "our"). By creating an account or using Outfi, you agree to these Terms. If you do not agree, do not use Outfi.

1.Eligibility

You must be at least 16 years old and able to form a binding contract under applicable law to use Outfi. If you are using Outfi on behalf of any other person or entity, you represent that you have authority to bind them to these Terms.

2.Your account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at outfi.app.team@gmail.com if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms or that we reasonably believe are being misused.

3.License to use Outfi

We grant you a personal, non-exclusive, non-transferable, revocable license to use Outfi for your own personal, non-commercial use, subject to these Terms and Apple's App Store Terms of Use. You may not:

copy, modify, distribute, sell, or lease any part of Outfi;
reverse engineer, decompile, or attempt to extract source code, except where this restriction is prohibited by law;
use automated tools, scrapers, or bots to access Outfi or its data;
circumvent any rate limits, security measures, or access controls;
use Outfi to violate any law or third-party right.

4.Your content

Outfi allows you to upload content, including your avatar photo, Fits names and cover images, and other profile content ("Your Content"). You retain ownership of Your Content. By uploading Your Content, you grant us a worldwide, royalty-free, non-exclusive license to host, store, display, reproduce, and process Your Content solely for the purpose of operating Outfi for you.

You represent that Your Content does not infringe any third party's rights and complies with these Terms.

5.Acceptable use

You agree not to upload, post, or transmit any content that:

is illegal, fraudulent, defamatory, obscene, or hateful;
infringes any intellectual property right;
impersonates any person;
contains malware or harmful code;
harasses, threatens, or invades the privacy of any person.

6.Affiliate disclosure

Outfi participates in the Amazon Associates Program. Some product links in Outfi are affiliate links, meaning we may earn a commission when you purchase a product through them, at no additional cost to you. We mark affiliate links where required, and our participation in this program does not affect the price you pay or our recommendations.

As an Amazon Associate, we earn from qualifying purchases.

7.Third-party services and links

Outfi displays product information from Amazon retrieved through third-party APIs and links you out to Amazon to complete purchases. We do not control Amazon, and your interactions with Amazon (including purchases, returns, payments, shipping, and customer service) are governed entirely by Amazon's terms and policies. We are not a seller, retailer, or party to any transaction between you and Amazon.

8.Intellectual property

Outfi, including the name "Outfi," the logo, the App, and all associated content (excluding Your Content and product information sourced from third parties), is owned by us and protected by intellectual property laws. We reserve all rights not expressly granted in these Terms.

9.Product information disclaimer

Product information shown in Outfi (titles, prices, images, availability, descriptions) is provided by third-party sources and may be inaccurate, incomplete, or out of date. Prices and availability change frequently. We make no representation about the accuracy of any product information. Always confirm details on the retailer's site before purchase.

10.AI-assisted recommendations

Some features of Outfi use artificial intelligence, including third-party large language models, to generate style recommendations based on your style profile. AI output may be inaccurate, inappropriate for your needs, or inconsistent. Use your own judgment when acting on recommendations.

11.No warranties

OUTFI IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF DATA. WE DO NOT WARRANT THAT OUTFI WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

12.Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF OUTFI, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR OUTFI WILL NOT EXCEED THE GREATER OF (A) USD 50 OR (B) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so the above limitations may not apply to you.

13.Indemnification

You agree to indemnify and hold harmless Outfi and its operator from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of (a) your use of Outfi, (b) Your Content, or (c) your violation of these Terms or any law or third-party right.

14.Termination

You may stop using Outfi and delete your account at any time. We may suspend or terminate your access at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, the rights granted to you under these Terms will end, but Sections 8, 11, 12, 13, 15, and 16 will survive.

15.Governing law and venue

These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or Outfi will be resolved exclusively in the state or federal courts located in Collin County, Texas, and you consent to personal jurisdiction in those courts. Nothing in this section prevents either party from bringing a claim in small claims court where eligible.

16.Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you in-app or by email and update the "Last updated" date above. Your continued use of Outfi after the effective date constitutes acceptance of the revised Terms.

17.Apple App Store

If you accessed Outfi through the Apple App Store, you acknowledge that:

These Terms are between you and us, not Apple. Apple is not responsible for Outfi or its content.
Apple has no obligation to provide maintenance or support for Outfi.
In the event of any failure of Outfi to conform to any applicable warranty, you may notify Apple, who will refund the purchase price (if any). Apple has no other warranty obligation.
Apple is not responsible for addressing claims by you or any third party relating to Outfi or your use of it.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

18.Miscellaneous

These Terms (together with our Privacy Policy) are the entire agreement between you and us regarding Outfi. If any provision is held unenforceable, the remaining provisions will remain in effect. Our failure to enforce any provision is not a waiver of that provision. You may not assign these Terms; we may.
